These Terms apply to the Website itself. Purchases made through shop.ephemeraworks.com are also subject to the terms, policies, checkout disclosures, and other conditions presented through the Fourthwall-powered storefront, as described below.

3. EPHEMERA WORKS ONLINE STORE

Ephemera Works maintains a separate online storefront accessible at:

The storefront is powered and operated through Fourthwall.

The Website may contain links, buttons, product previews, promotional material, or other features that direct you to the Fourthwall-powered storefront. Following such a link may take you from the independently operated Ephemera Works Website to services provided through Fourthwall.

For products offered for sale through the Fourthwall storefront, Fourthwall acts as the seller or merchant of record as provided under Fourthwall’s applicable terms and policies. Fourthwall may provide or coordinate services including checkout, payment processing, applicable tax collection and remittance, order processing, production, fulfillment, shipping, and customer-support functions.

Ephemera Works creates, selects, licenses, markets, or otherwise makes available the artwork and designs associated with products offered through the storefront, but the technical operation of the Fourthwall storefront and transactions processed through it are subject to Fourthwall’s applicable terms, policies, and checkout disclosures.

Before completing a purchase, you should review all terms, product information, pricing, shipping information, return or refund information, and other disclosures presented through the storefront.

If there is a conflict between these Website Terms and a Fourthwall term specifically governing a product purchase, payment, fulfillment, shipping, return, refund, or other storefront transaction, the applicable storefront or Fourthwall transaction terms will govern that transaction to the extent of the conflict.

Nothing in these Terms expands or limits Fourthwall’s obligations under its own terms or applicable law.

4. NO PURCHASE REQUIRED TO USE THE WEBSITE

You are not required to make a purchase to view the Website, portfolio, About page, or other generally available Website content.

Visiting the Website does not create a customer relationship, agency relationship, partnership, joint venture, employment relationship, fiduciary relationship, or other special relationship between you and Ephemera Works.

A purchase relationship may arise separately when you complete a transaction through the Fourthwall-powered storefront according to the terms governing that transaction.

• Training an artificial-intelligence or machine-learning system;
• Fine-tuning an artificial-intelligence model;
• Creating or expanding an image, text, design, or multimedia dataset;

• Creating unauthorized derivative datasets or archives; or

The name Ephemera Works, associated logos, trade dress, graphic identifiers, and other brand elements may be protected by trademark, copyright, unfair-competition, or other applicable laws.

Nothing in these Terms grants a license to use Ephemera Works branding for commercial purposes.

Interaction with an Ephemera Works social-media account does not create a contractual, professional, employment, agency, or fiduciary relationship with Ephemera Works.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EPHEMERA WORKS AND ITS OWNER,EMPLOYEES, CONTRACTORS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL,SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM YOUR ACCESS TOOR USE OF THE WEBSITE, INCLUDING LOST PROFITS, LOST BUSINESS OPPORTUNITIES, OR LOST DATA.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPHEMERA WORKS’ TOTAL AGGREGATE LIABILITY ARISING SOLELY FROM YOUR USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED,INCLUDING LIABILITY ARISING FROM FRAUD, WILLFUL MISCONDUCT, OR OTHER MATTERS FOR WHICH APPLICABLE LAW PROHIBITS LIMITATION.

This section governs liability relating to the independently operated Website. Liability concerning transactions conducted through the Fourthwall storefront may also be governed by the terms applicable to those transactions.

27. COURTS AND VENUE

Except where mandatory law permits or requires another forum, legal proceedings arising specifically fromthese Terms or use of the Website may be brought in a state court located in Harris County, Texas, or aUnited States federal court having jurisdiction over Harris County, Texas.

Each party consents to the jurisdiction of those courts to the extent legally permitted.

This section does not govern a dispute that is required to be handled differently under terms applicable to a Fourthwall storefront transaction.

28. NO MANDATORY ARBITRATION OR CLASS-ACTION WAIVER

These Website Terms do not presently require mandatory arbitration, waive the right to a jury trial, orimpose a class-action waiver.

Ephemera Works may revise its dispute-resolution provisions in the future, subject to applicable notice, contract-formation, and consumer-protection requirements.

Any future material change will not be applied retroactively where doing so would be unlawful or unenforceable.

29. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will been forced to the maximum lawful extent or severed to the minimum extent necessary.

The remaining provisions will remain in effect.

30. NO WAIVER

If Ephemera Works does not enforce a provision of these Terms in a particular situation, that does not meanthe provision has been permanently waived.

A waiver is effective only to the extent expressly made by the party granting it.

31. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any other Website policies expressly incorporated intothem, constitute the agreement between you and Ephemera Works concerning your use of www.ephemeraworks.com.

They do not replace separate terms governing purchases, payments, fulfillment, refunds, shipping, or othertransactions conducted through the Fourthwall storefront.
